Karl David J. Farrell, petitioner herein, was convicted on November 15, 1962, of three counts of indecent behavior with a child contrary to sec. 944.01, Stats. 1961. Pursuant to sec. 959.15 (1), Stats. 1961 (now sec. 975.01), the court ordered the state department of public welfare (now the department of health & social services) to administer a presentence social, physical, and mental examination to petitioner. The department concluded petitioner was in need of specialized treatment as a sex deviate and, pursuant to such recommendation, the trial court ordered petitioner committed under sec. 959.15 (6), Stats. 1961 (now sec. 975.06). For approximately ten years thereafter petitioner was either confined in Central State Hospital or the state prison at Waupun or on parole. On October 8, 1971, this court in State ex rel. Farrell v. Schubert, 1 required the department to restore petitioner's accumulated good time. After such decision, the department elected to discharge petitioner who is presently, according to the state public defender, a university student.
