This is an extradition case and involves an appeal from an order quashing a writ of . While the appellant Isaac Foster was an inmate in the Wisconsin state prison at Waupun, the state of Indiana on February 25, 1963, filed a detainer charging him with the crime of robbery on December 7, 1962, in Marion county, Indiana. No action to bring Foster to trial was taken by Indiana although several requests were made by Foster. On September 23, 1964, a few weeks before Foster's conditional release from the state prison, the state of Indiana commenced an extradition proceeding. An affidavit on that day was sworn to by a police officer before a Justice of the peace in Marion county. A deputy clerk of the criminal court of that county issued an arrest warrant and upon these documents the governor of Indiana executed his requisition certifying that Isaac Foster stood charged by an affidavit pending in Marion county with the crime of robbery committed in Indiana and had fled from the Justice of that state. These documents were presented to the governor of the state of Wisconsin who issued his extradition warrant on October 8, 1964.
